Article 1: Preamble

The present conditions of sale are concluded, on the one hand, by the company Provoc Agency srl (under the trade name YAKAJOBS) whose registered office is located at Champ de Presenne 38, 1390 Grez-Doiceau registered with the Banque Carrefour des Entreprises under number 0789 234 857 hereinafter referred to as “the seller” or “YAKAJOBS” and, on the other hand, by any individual or legal entity wishing to make a purchase via the seller’s website, hereinafter referred to as “the buyer”.

Article 2: Purpose

The purpose of these terms and conditions of sale is to define the contractual relationship between the seller and the buyer, as well as the conditions applicable to all purchases made through the seller’s website, whether the buyer is a professional or a consumer. The acquisition of a good or service through this site implies unreserved acceptance by the buyer of these conditions of sale. These conditions of sale shall prevail over any other general or special conditions not expressly approved by the seller. The seller reserves the right to modify its conditions of sale at any time. In this case, the conditions applicable will be those in force at the date of the order by the purchaser.

Article 3: Characteristics of the goods and services offered

The services offered are those listed on the seller’s website. Each service is accompanied by a description. If, despite its best efforts, all or part of the items are unavailable, the seller will inform the buyer by email as soon as possible and offer the buyer the option of waiting or cancelling the order of the unavailable items at no charge. Available items will be delivered as usual.

Article 4: Rates The prices of the services displayed on the site are indicated in euros, all taxes excluded (VAT and other applicable taxes). The seller reserves the right to modify its prices at any time. Nevertheless, the prices applicable to the order are those in force at the time of order confirmation.

Article 5: Geographical zones

The online sale of services presented on the seller’s website is not subject to any geographical restrictions.

Article 6: Orders

Buyers wishing to purchase a product or service must :

Create a YAKAJOBS account and fill in your contact details;
Choose the service you wish to subscribe to;
Confirm your order after checking it;
Make payment as agreed;

Confirmation of payment implies acceptance of these terms and conditions of sale, acknowledgement of full knowledge thereof and waiver of the right to invoke one’s own terms and conditions of purchase or any other terms and conditions. All the data provided and the recorded confirmation will constitute proof of the transaction. Confirmation will constitute signature and acceptance of the operations carried out. The seller will send confirmation of the registered order by e-mail.

Article 7: Right of renunciation

By subscribing to our services, you request immediate execution of the service and acknowledge that, in this respect, you cannot exercise your right of withdrawal in accordance with the provisions of article 121-20-2 of the French Consumer Code.

Article 8: Terms of payment

Payment is made by credit card, Visa or Mastercard via a third-party service (Hipay, Stripe or Paypal). For any change of payment method, you will need to modify the information in your account. You will be able to renew payment at any time via your account, as well as select a new purchase type or start a new purchase once the previous one has expired. The purchase will end on its scheduled expiry date, and you will continue to enjoy the benefits associated with it until that date. You can subscribe to a new purchase at any time.

Article 9: Deliveries

The service is automatically delivered to the account of the buyer who placed the order. The number of days linked to the chosen offer is directly added to the number of days remaining on the YAKAJOBS account.

Article 10: Liability

The seller, in the online sales process, is bound only by an obligation of means; it cannot be held liable for any damage resulting from the use of the Internet network, such as loss of data, intrusion, viruses, disruption of service or other involuntary problems. All information on the site is given in good faith. Links to manufacturers’ and/or partners’ websites are provided for information purposes only. The seller cannot be held responsible for information from these sites.

Article 11: Intellectual property

All elements of the seller’s site are and remain the exclusive intellectual property of the seller. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or audio.

Article 12: Personal data

All personal data required to process an order are stored by the seller or its employees and may be passed on to companies with which the seller – or its suppliers – collaborate(s), when such communication is necessary to process the order. The user also authorizes the seller to use this data to compile statistics in order to improve its site and the goods and services it offers. This information may also be used to disseminate, by any means of communication, information relating to the seller’s commercial activities to its customers. Lastly, the seller retains personal data to facilitate subsequent orders. In addition, the seller undertakes not to divulge any information in its possession to any other company or business. The data stored by the seller can be requested and corrected at any time.

Article 13: Evidence

The parties accept, within the framework of their relations, electronic means of proof (by way of example: email, computer backups, etc.).

Article 14: Settlement of disputes

These online sales conditions are governed by Belgian law. In the event of a dispute, the courts of the seller’s registered office shall have jurisdiction, except in the case of mandatory public policy provisions.
