Terms and conditions of use for companies on YAKAJOBS
Effective date: February 25, 2024
By registering and using the services offered by YAKAJOBS to find candidates, you agree to these terms and conditions. Please read them carefully before proceeding.
Recruitment Department
1.1. YAKAJOBS offers a recruitment service where we carefully interview and evaluate candidates in order to offer you the best professionals/retirees available to meet your needs.
1.2. Our principle is “no cure, no pay”. You only pay fees when you actually hire the retiree.
1.3. Our retirees are flexible in terms of availability, being available for assignments ranging from one day to over a year, with availability ranging from 10% to full-time.
Special Offers
2.1. Freelance/Consultant offer :
– We take no commission on the daily rate negotiated directly with the freelancer.
– Retirees are offered free of charge.
– You only pay our daily rate if the retiree is hired.
– The exclusive contract between the company and the retiree is for 12 months.
2.2. Offer in Payroll/Salarié :
– We take no commission on the remuneration negotiated directly with the retiree.
– Retirees are offered free of charge.
– The company only pays if the retiree is hired.
– The exclusive contract between the company and the retiree is for 24 months.
Pricing and Payment Terms
3.1. For the Freelance/Consultant Offer :
– A fee of 850,-€ excl. VAT is charged for the first day of work.
– From the second day of work, the fee is €60.00 per day, excluding VAT, for a maximum of 12 months.
– Payment is due 10 days after receipt of invoice (after validation of timesheet).
3.2. For the Payroll/Employee Offer :
– The company undertakes to pay a fixed annual fee of €3,650.- excluding VAT.
– This lump sum is payable at the start of the collaboration and on the 1st of the 13th month, if the collaboration is still in progress.
Privacy and Data Protection
4.1. YAKAJOBS undertakes to protect the confidentiality of all information provided by the company and to use such information only in connection with the recruitment services provided.
4.2. The information provided by the company will be treated in accordance with the YAKAJOBS privacy policy.
Company responsibilities
5.1. The company is responsible for providing accurate, up-to-date information on its recruitment needs and vacancies.
5.2. The company is committed to using recruitment services in an ethical and legal manner, and to respecting the rights of candidates.
Modifications to the Conditions
6.1. YAKAJOBS reserves the right to modify these terms and conditions at any time, at its sole discretion. Modifications will come into force as soon as they are published on the Platform.
6.2. It is the company’s responsibility to consult the updated conditions on a regular basis.
Non-payment of recruitment fees
If the company fails to pay the recruitment fees in accordance with the terms and conditions, YAKAJOBS reserves the right to temporarily suspend or permanently terminate the company’s access to the Platform and its services. In addition, late fees may be applied according to the terms defined in the payment conditions.
Breach of confidentiality
In the event of a breach of confidentiality of information provided by YAKAJOBS or by candidates, the company may be exposed to legal proceedings and claims for damages, with a minimum of 20,000 eur excluding VAT. YAKAJOBS reserves the right to take all necessary measures to protect the confidentiality of candidates’ information as well as its own data.
Platform misuse
If the Company uses the Platform in a manner that violates the Terms and Conditions or applicable law, YAKAJOBS may take action such as temporarily suspending or permanently terminating the Company’s account. YAKAJOBS also reserves the right to report any illegal activity to the appropriate authorities.
Claims and disputes
10.1. In the event of a dispute between YAKAJOBS and the company, both parties undertake to resolve the dispute amicably. If no amicable resolution is possible, the parties agree to submit the dispute to arbitration in accordance with the laws in force in Belgium via the Court of Nivelles where YAKAJOBS carries out its activities.
10.2. Failure to comply with the terms and conditions may result in legal action being taken against the company, including claims for damages, as well as legal and judicial costs incurred by YAKAJOBS in enforcing its rights.
10.3 By using the services of YAKAJOBS, the company agrees to comply with all the provisions of the general terms and conditions and to respect the consequences set out above in the event of non-compliance. These measures are taken to protect the rights and interests of YAKAJOBS, candidates and other users of the Platform.
Acceptance of Terms
By registering with YAKAJOBS, you agree to these terms and conditions. These conditions may be subject to change from time to time. It is your responsibility to regularly check the updated conditions.
